Appeal Court Ruling Secures KEK & Gardner Brands

THE COURT of Appeal has upheld a High Court ruling ensuring that UK engineering brands KEK & Gardner remain the exclusive property of their original owner, Cheshire-based Process Components Ltd.

The ruling confirms Process Components Ltd.’s exclusive right to manufacture and sell its Kek and Gardner brands of industrial powder processing machines and components worldwide.

Despite having appealed the Court decision, Kason Europe Ltd (Formerly Kason Kek Gardner Ltd.) remains bound not to infringe Process Components Ltd.’s designs or trademarks in the future.

Process Components Ltd. designs and manufactures powder-handling and processing equipment used in the food, chemical, powder coating and pharmaceutical sectors worldwide. Its brands are Kek, Gardner, Mucon and PPS.

Commenting on the ruling, Tony Goodwin, managing director of Process Components, said:

“As far as the market is concerned, nothing has changed: these widely known and trusted brands will remain as they have always been, under their original ownership. Having put the case behind us we are pleased that we can continue to focus on developing and manufacturing top quality equipment.

Process Components is reassuring Kek and Gardner customers that they can remain confident of full product support for the future: the company holds customer archives going back many decades, including bespoke designs, warranty information and machine blueprints, and has recently announced significant investment into its global expansion, relocation of its global headquarters in the UK, and the creation of an R&D and training centre.
